## Preamble
This Custom "Clopen" License ("License") governs the use, distribution, and modification of Minecraft modifications ("Mods") developed and maintained by Insanity Labs and Insanity Studios ("Licensor"). The Mods are released under an open-source model with specific restrictions to protect the integrity and originality of the projects, while remaining open for community extensions and pack integration. Licensor recognizes the value of open-source principles while maintaining necessary protections against unauthorized commercial exploitation and derivative works.

## 1. Definitions
- **"Mod" or "Mods"**: Any Minecraft modification developed by Licensor, including all source code, compiled binaries, documentation, and associated assets, whether published or in development.
- **"Source Code"**: All client-side and server-side code, including but not limited to Java source files, configuration files, build scripts, and associated resources comprising a Mod.
- **"Extension API"**: Any publicly disclosed and documented application programming interface, including but not limited to public classes, interfaces, events, hooks, and methods, provided by Licensor for third-party development and extensions.
- **"API Extension Addon Mod"**: Community-developed modifications, plugins, add-ons, or extensions that extend a Mod's functionality through the provided Extension API, without modifying, compiling, incorporating, or redistributing the Mod's Source Code or compiled binaries.
- **"Modpack"**: A curated collection of compiled Mod binaries, including one or more Mods developed by Licensor, distributed together for use with Minecraft.
- **"Port"**: The adaptation, modification, or recompilation of a Mod's Source Code for use with different mod loaders, Minecraft versions, platforms, or other systems.
- **"Binary"**: The compiled, executable form of a Mod, typically in .jar or .class file format, ready for use in Minecraft.
- **"Personal Use"**: Use of a Mod or compiled Binary limited to the individual user's private installations and gameplay, excluding any form of distribution, public display, commercial use, or shared hosting.
- **"Official Release Channels"**: The authorized distribution platforms including, but not limited to: GitHub Releases tab, Modrinth project pages, and CurseForge project pages (if applicable).
- **"Licensor"**: Insanity Labs (IL) and Insanity Studios (IS), collectively or individually as context applies.
- **"Contributor"**: Any individual or entity that submits code, documentation, assets, or other creative content to a Mod's official repository.
- **"Unauthorized Secondary Distribution"**: Any redistribution of Source Code, compiled Binaries, or derivative works not explicitly permitted by this License or approved through official contribution channels.

## 2. Grant of Rights
Subject to the terms and conditions of this License, Licensor grants users the following non-exclusive, revocable rights:
### 2.1 Rights Granted
Users are permitted to:
- Access, view, and study the Source Code of any Mod available in public repositories for educational, informational, and analytical purposes
- Use Mods in their compiled Binary form as intended in their original distribution for personal, non-commercial gameplay
- Build or compile the Source Code into Binaries for personal use only, on the user's own computing devices
- Include compiled Mods in modpacks for distribution without prior approval
- Develop API Extension Addon Mods using any publicly documented Extension API
- Submit bug reports, feature requests, and feedback through official channels
- Contribute code, documentation, and assets to a Mod's development through official repository contribution channels, subject to approval and the terms of Section 3.3
### 2.2 Limitations on Rights
All rights granted are subject to the restrictions, limitations, and conditions specified throughout this License. No rights are granted beyond those explicitly stated herein.

## 3. Source Code Access, Compilation, and Personal Use
### 3.1 Source Code Availability and Personal Compilation
Licensor provides Source Code in public repositories to facilitate transparency, community involvement, and educational purposes. Users are expressly permitted to:
- Clone, fork, or download the Source Code from official repositories
- Compile or build the Source Code into Binaries (typically .jar files) on their personal computing devices
- Use compiled Binaries resulting from personal compilation for personal use exclusively
This permission is granted with the understanding that such Binaries are for the sole benefit of the compiling user and may not be distributed, shared, or made available to any other party.
### 3.2 Personal Use Definition and Restrictions
For purposes of this License, "Personal Use" is defined as:
- Installation and operation of compiled Binaries on the user's own Minecraft client or server installations
- Gameplay and interaction with Mods in single-player environments or private servers where the user has exclusive administrative control
- Study, testing, and experimentation for private educational purposes
Personal Use **explicitly excludes**:
- Any form of public distribution, redistribution, or sharing of compiled Binaries, source code, or derivative works
- Hosting, uploading, or mirroring Binaries on public or semi-public servers, repositories, or file-sharing platforms
- Commercial use, monetization, or profit generation
- Integration into publicly-available modpacks, resource packs, or software distributions
- Modification and redistribution of compiled Binaries or Source Code in any form
### 3.3 Official Binary Distribution Channels
Licensor distributes compiled, official Binaries exclusively through the following Official Release Channels:
- **GitHub Releases Tab**: The Releases section of the official Mod repository on GitHub
- **Modrinth Project Pages**: The official project page on the Modrinth mod distribution platform
- **CurseForge Project Pages**: The official project page on CurseForge (if the Mod is published there)
Users are strongly encouraged to obtain compiled Binaries from these Official Release Channels rather than compiling Source Code personally. Official Binaries are tested, verified, and maintained by Licensor. Use of Binaries from any source other than these Official Release Channels is at the user's sole risk.

## 4. Source Code and Usage Restrictions
### 4.1 General Source Code Restriction and Prohibited Uses
The Source Code of any Mod (both client-side and server-side components) may **NOT**, in whole or in part, be:
- Incorporated, integrated, merged, or embedded into any other standalone project, modification, or software application
- Reused, copied, adapted, or refactored for use outside the context of the respective Mod's official development or authorized modpack inclusion
- Distributed, published, uploaded, or made available to any third party in modified, unmodified, obfuscated, or decompiled form
- Used as a foundation, framework, template, or architectural basis for derivative standalone works or projects
- Sublicensed, relicensed, or offered under alternative licensing terms
- Compiled and distributed as Binaries except through Official Release Channels or as permitted under Personal Use (Section 3.2)
### 4.2 Permitted Uses: Modpacks and API Extensions
Notwithstanding Section 4.1, the following uses do **NOT** violate this License:
#### 4.2.1 Modpack Inclusion
- Official compiled Binaries of any Mod obtained from Official Release Channels may be freely included in modpacks without prior approval or additional licensing
- Modpack creators may distribute official Binaries as components of modpack distributions
- Modpack creators are not required to seek separate authorization for each Mod included, provided the Binaries are obtained from Official Release Channels
- Modpack creators may not modify, recompile, or alter Mod Binaries before inclusion in modpacks
#### 4.2.2 API Extension Addon Mods
- Developers may freely create, develop, and distribute API Extension Addon Mods that extend a Mod's functionality exclusively through the documented Extension API
- No prior written permission is required for API Extension Addon Mod development, provided they do not incorporate, compile, or reference the Mod's Source Code
- API Extension Addon Mods must not contain, reference, import, or depend upon non-public Source Code elements
- Developers are encouraged to create and share API Extension Addon Mods and may publish them on any platform, including Modrinth and CurseForge
- API Extension Addon Mods remain the intellectual property of the developer and may be licensed under any terms chosen by the developer
### 4.3 Contributions to Official Repositories
Community contributions to any Mod's official repository are strongly welcomed and encouraged. However, all contributions must:
- Follow the guidelines and requirements outlined in the respective Mod's CONTRIBUTING.md document, including code standards, testing requirements, and documentation specifications
- Meet quality, security, stability, and functionality standards as determined solely by Licensor
- Be submitted exclusively via official repository contribution mechanisms (pull requests, issue tracking, or other official channels)
- Be subject to review, testing, and approval by Licensor prior to acceptance
- Not infringe upon any third-party intellectual property rights
#### 4.3.1 Contributor Rights and Ownership
Upon submission of a contribution to an official repository, Contributors expressly grant Licensor:
- Perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, and sublicense the contributed content
- Full rights to incorporate the contribution into the Mod and all derivative works
- Rights to modify, enhance, or refactor the contribution without further notice to the Contributor
Contributors retain the right to receive attribution for accepted contributions in accordance with Section 5.
### 4.4 Prohibition of Unauthorized Derivative Works and Secondary Distribution
Any unauthorized copying, reproduction, repackaging, redistribution, or secondary use of a Mod's Source Code, compiled Binaries, or derivative works in any form is strictly prohibited. This includes, but is not limited to:
- Redistributing modified or unmodified Source Code as a standalone project, whether on GitHub, GitLab, or any other platform
- Creating, publishing, or distributing derivative works based substantially on the Source Code without explicit written permission from Licensor
- Incorporating substantial portions of the Source Code into other projects, utilities, or applications outside the scope of Personal Use, modpack inclusion, or documented Extension API development
- Obfuscating, decompiling, reverse-engineering, disassembling, or otherwise attempting to derive the Source Code from compiled Binaries, then redistributing the results or using them in unauthorized projects
- Extracting logic, algorithms, code patterns, or architectural elements from the Source Code and reusing them in other projects
- Creating alternative implementations that substantially replicate the functionality and design of a Mod's Source Code
Such unauthorized secondary use and redistribution of Source Code or derivative works constitutes material breach of this License and may subject the violating party to legal action.

## 5. Port Restrictions
### 5.1 Prohibition on Unauthorized Ports of Source Code
Porting, adapting, or recompiling a Mod's Source Code to different mod loaders, Minecraft versions, platforms, or other systems is **NOT PERMITTED** without prior written approval from Licensor (IL or IS).
This prohibition includes, but is not limited to:
- Porting from one mod loader framework to another (e.g., Forge to Fabric, Forge to Quilt, Fabric to NeoForge)
- Modifying core Source Code to support new Minecraft versions and releasing the result independently
- Adapting the Source Code for use on other game platforms or engines
- Creating parallel implementations for alternative Minecraft server software or proxies
- Decompiling compiled Binaries and adapting the decompiled code for alternative loaders or versions
### 5.2 Exception: API Extension Addon Mods Supporting Multiple Versions and Loaders
Creating API Extension Addon Mods that support multiple Minecraft versions or mod loaders through the documented Extension API does **NOT** require prior approval and is explicitly encouraged. Such extensions:
- May target any Minecraft version without restriction
- May be developed for any mod loader or environment
- Must rely exclusively on the documented Extension API and publicly exposed interfaces
- Remain entirely under the developer's control and intellectual property ownership
### 5.3 Formal Approval Process for Source Code Ports
Any individual or organization seeking to port a Mod's Source Code to different mod loaders or platforms must follow this formal approval process:
#### 5.3.1 Submission Requirements
- Submit a written request to Licensor detailing the proposed port, including the target mod loader, Minecraft version(s), and any substantial modifications planned
- Provide comprehensive technical documentation explaining the porting approach, architectural changes, and compatibility considerations
- Demonstrate understanding of the Mod's design, functionality, and technical requirements
- Disclose any conflicts of interest or commercial motivations
- Allow a minimum of 14 calendar days for Licensor's review and decision
#### 5.3.2 Approval Decision
- Licensor will review the port request based on project alignment, technical feasibility, maintenance burden, community need, and other relevant factors
- Licensor may approve the request without conditions, approve with specific conditions or requirements, request modifications to the proposal, or deny the request entirely
- Licensor's decision is final and made at its sole discretion
- Licensor will provide written communication of its decision to the applicant within a reasonable timeframe
#### 5.3.3 Terms of Approved Ports
Should a port be approved, Licensor may require:
- Ongoing maintenance of the port to maintain compatibility with updated versions of the Mod and Minecraft
- Adherence to quality, stability, and security standards matching the original Mod
- Periodic communication and coordination with Licensor regarding development status
- Use of official branding or clear indication that the port is community-maintained (if not directly maintained by Licensor)
- Hosting the port in a publicly accessible repository with proper attribution
### 5.4 Exception: Ports Contributed Through Official Repository Channels
Port contributions submitted through official repository contribution channels and approved according to the Contribution Guidelines (CONTRIBUTING.md) do **NOT** require the separate formal approval process described in Section 5.3. Such contributions:
- Must follow the standard contribution review and approval process outlined in CONTRIBUTING.md
- Upon acceptance and merging into the official repository, become part of the official Mod
- Are maintained as part of the official project by Licensor
- Contributors receive attribution in accordance with Section 5 of this License

## 6. Attribution and Credits
### 6.1 Contributor Attribution and Visibility
All contributors who have had contributions accepted and merged into an official Mod repository will receive prominent attribution in the following visible locations:
#### 6.1.1 In-Game Credits Menu
- A dedicated credits, contributors, or about menu accessible from within the Mod's interface or configuration screen
- Credits shall display contributor names or usernames in a clear, readable format
- This credits menu shall be easily accessible to all users running the Mod
#### 6.1.2 README.md Documentation
- The Mod's primary README.md documentation file shall contain a contributors section
- This section shall be located prominently at the bottom of the README or in a dedicated "Contributors" or "Credits" section
- Contributors shall be listed in order of contribution significance or chronological order at Licensor's discretion
#### 6.1.3 CONTRIBUTING.md Documentation
- The Mod's CONTRIBUTING.md file shall maintain an updated list of all accepted contributors
- This list shall include information sufficient to identify each contributor
- The CONTRIBUTING.md file serves as official documentation of community participation
### 6.2 Attribution Information Requirements
To receive attribution, Contributors must provide Licensor with the following information:
- A display name, username, or public identifier for use in credits
- Optionally, a GitHub username or profile URL
- Optionally, a personal website, portfolio, or social media link
- Optionally, a preferred email address for contact
Contributors may request updates to their attribution information at any time.
### 6.3 Attribution Rights and Acknowledgment
- Licensor commits to acknowledging all accepted contributions in the manner specified in Section 6.1
- Contributors grant permission for their names and usernames to be displayed in the locations specified herein
- Attribution is automatic upon contribution acceptance and does not require separate approval from the contributor

## 7. Distribution and Official Channels
### 7.1 Official Release Channels
Licensor authorizes distribution of compiled Mod Binaries exclusively through the following Official Release Channels:
- **GitHub Releases**: The Releases section of the official Mod repository on GitHub.com
- **Modrinth**: The official Mod project page on the Modrinth platform (modrinth.com)
- **CurseForge**: The official Mod project page on CurseForge (curseforge.com), where applicable
Official Binaries distributed through these channels are tested, verified, maintained, and supported by Licensor.
### 7.2 Modpack Distribution
- Compiled Binaries obtained from Official Release Channels may be freely included in modpack distributions without additional authorization
- Modpack creators should obtain Binaries directly from Official Release Channels
- Modpack creators may not modify, recompile, or alter Binaries before inclusion
### 7.3 Third-Party Distribution
- Distribution of Mods through platforms or channels other than Official Release Channels is not authorized by Licensor
- Users are advised that Binaries obtained from unauthorized sources may be outdated, modified, compromised, or counterfeit
- Licensor assumes no responsibility for Mods distributed through unauthorized channels and cannot verify their integrity or safety
### 7.4 License Inclusion Requirements
- Any authorized distribution must include this License in its entirety or provide a prominent link to the authoritative License text
- Modpack creators are not required to include this License in their pack distribution, but the Mod itself remains governed by this License

## 8. Personal Modification and Private Use
### 8.1 Private Modifications
Users may create personal modifications of a Mod for private use on their own systems, provided:
- Modifications are created solely for the modifying user's private installations and use
- Modifications are not distributed, shared, uploaded, or made available to any other party
- Modified Binaries are not released, published, or offered through any platform or distribution channel
### 8.2 Scope of Private Modification
- Modifications for private use may include bug fixes, feature adjustments, performance optimizations, or other alterations
- Private modifications may not be distributed under any circumstances
- Licensor does not review, approve, or endorse private modifications
### 8.3 Recommendation for Significant Improvements
Users who create significant improvements, bug fixes, or features during private modification are encouraged to:
- Contribute their improvements to the official repository through the contribution process outlined in Section 3.3
- Contact Licensor to discuss potential integration
- Share feedback and suggestions through official community channels

## 9. Disclaimer of Warranty
### 9.1 AS-IS Provision
The Mods, including all Source Code and compiled Binaries, are provided in an "AS IS" condition without any warranty of any kind, whether express, implied, statutory, or otherwise.
### 9.2 Disclaimer of Implied Warranties
Licensor expressly disclaims all implied warranties, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement of third-party intellectual property rights
- Warranties that the Mods will be error-free, uninterrupted, or secure
- Warranties regarding the accuracy, completeness, or usefulness of any documentation or features
- Warranties that defects in the Mods will be corrected
### 9.3 No Guarantee of Support
Licensor makes no guarantee regarding:
- Continued development, maintenance, or updates to any Mod
- Technical support, debugging assistance, or customer service
- Compatibility with specific Minecraft versions, mods, or systems
- Performance characteristics or resource requirements

## 10. Limitation of Liability
### 10.1 Liability Cap
**IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DAMAGES OF ANY KIND**, whether direct, indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to:
- Loss of data, revenue, profits, or business opportunity
- Loss of use, availability, or functionality
- Damage to hardware, software, or computer systems
- Emotional distress, inconvenience, or frustration
- Any other form of pecuniary or non-pecuniary loss
...arising from or in any way connected with:
- The use of or inability to use any Mod
- The quality, functionality, or performance of any Mod
- Unauthorized access to or alteration of user data or systems
- The conduct of any third party in relation to the Mods
- Any other matter related to the Mods or this License
### 10.2 Applicability
This limitation applies even if Licensor has been advised of the possibility of such damages and even if any remedy fails of its essential purpose.

## 11. Termination and Revocation of Rights
### 11.1 Termination for Violation
Licensor reserves the right to revoke, suspend, or terminate the rights granted under this License, in whole or in part, to any individual or organization that:
- Violates any material term or condition of this License
- Engages in unauthorized secondary distribution or derivative works
- Attempts to circumvent or circumvents the protections in this License
- Creates or distributes unauthorized ports without approval
- Infringes upon Licensor's intellectual property rights
- Engages in abusive, harassing, or fraudulent conduct related to the Mods
### 11.2 Termination Process
- Licensor will provide written notice of termination to the violating party when practical
- Termination is effective immediately upon written notice or upon Licensor's unilateral determination
- Licensor may pursue additional legal remedies in accordance with applicable law
### 11.3 Effect of Termination
Upon termination of rights:
- The user must immediately cease all use of the affected Mod(s)
- All rights to download, compile, use, or distribute the Mod(s) are immediately revoked
- The user must remove all Binaries, Source Code, and derivative works of the Mod from all public and private systems under their control, including personal devices, servers, repositories, and storage systems
- The user must cease hosting, distributing, or making available any copies of the Mod in any form
- Licensor may pursue legal action to enforce compliance

## 12. Pricing, Donations, and Free Distribution
### 12.1 Free Distribution
All Mods released by Insanity Labs and Insanity Studios under this License are provided **entirely free of charge** for use, compilation, gameplay, and all other permitted purposes. No fees, payments, or purchases are required to access, download, or use any Mod.
### 12.2 Donations and Support
While Mods are provided free of charge, Content Creators whose channels are monetized are required to provide support through donations to continue use of the Mods in their content beyond initial evaluation periods.
#### 12.2.1 Donation Requirements for Content Creators
Content Creators who generate revenue (monetization, sponsorships, donations, or other financial benefit) from content featuring Licensor's Mods may optionally provide support through donations to waive attribution requirements. Donations are **entirely voluntary and not required**.
**Optional Donation Scale (Per Mod, If Choosing to Donate):**
- **0 - 50,000 subscribers/followers**: $10 USD minimum donation per Mod
- **50,001 - 100,000 subscribers/followers**: $20 USD minimum donation per Mod
- **100,001 - 150,000 subscribers/followers**: $30 USD minimum donation per Mod
- **150,001 - 200,000 subscribers/followers**: $40 USD minimum donation per Mod
- **200,001 - 250,000 subscribers/followers**: $50 USD minimum donation per Mod
- **250,001 - 300,000 subscribers/followers**: $60 USD minimum donation per Mod
- **300,001 - 350,000 subscribers/followers**: $70 USD minimum donation per Mod
- **350,001 - 400,000 subscribers/followers**: $80 USD minimum donation per Mod
- **400,001 - 450,000 subscribers/followers**: $90 USD minimum donation per Mod
- **450,001 - 500,000 subscribers/followers**: $100 USD minimum donation per Mod
- **500,001 - 1,000,000 subscribers/followers**: $150 USD flat fee per Mod
- **1,000,001+ subscribers/followers**: Contact Licensor for custom licensing terms
**Donation Tier Limits and Auto-Waiver:**
- Donations cover **individual Mods** (i.e., a donation is made per Mod used)
- After donating for **2 (two) Mods**, all remaining Mods developed by Licensor **that are released under this License** are automatically covered at no additional cost
- A Content Creator who donates for any 2 Mods receives the attribution waiver and perpetual license for all other Mods **released under this License** in Licensor's catalog
- This "2-Mod Cap" incentivizes early support while providing complete freedom for broader Mod usage
Subscriber/follower counts are determined by the Content Creator's primary platform (YouTube, Twitch, TikTok, etc.) at the time of donation.
#### 12.2.1.1 Custom SMP (Survival Multiplayer) Pricing
Content Creator groups or networks running Custom Survival Multiplayer (SMP) servers may utilize Licensor's Mods under a flat-rate seasonal licensing model:
**Custom SMP Licensing Terms:**
- **One-Time Seasonal Fee**: $20 USD per SMP season
- **Coverage**: The $20 seasonal fee covers all members, contributors, and participants of the SMP project
- **Duration**: Licensing is valid for the specified season of the SMP (defined by the SMP organizers)
- **Multiple Mods**: The $20 seasonal fee covers unlimited use of any and all Mods developed by Licensor **released under this License** for that season
- **Attribution**: Standard attribution requirements apply unless waived by direct written permission from Licensor
**Custom SMP Licensing Process:**
- The SMP organizer or lead Content Creator contacts Licensor to register the SMP project
- Licensor confirms the SMP scope, expected duration, and participating creators
- Upon payment of the $20 seasonal fee, all team members are authorized to use any Licensor Mods in SMP content for that season
- At the end of the season or renewal, a new seasonal fee is required if continued use is desired
This model prevents per-creator fees for team-based content and supports collaborative SMP projects.
#### 12.2.2 Single Donation Requirement
- **One (1) minimum donation is required per Mod per Content Creator** (if choosing to donate) to waive attribution requirements and licensing restrictions
- This single donation grants perpetual, ongoing rights to use the Mod in content creation without additional licensing fees, recurring payments, or renewal requirements
- A Content Creator making a single donation at the required tier level establishes a permanent relationship and is not required to donate again
#### 12.2.3 Donation Channels
Donations may be submitted through official Licensor channels, including but not limited to:
- Ko-fi (ko-fi.com)
- Patreon (patreon.com)
- Other official donation platforms designated by Licensor
#### 12.2.4 Donor Recognition
All donors who provide support through official donation channels will be recognized and credited in a dedicated **DONORS.md** file maintained in each Mod's official repository. The DONORS.md file shall list:
- Donor names or usernames (as provided by the donor)
- Donation amount or tier (if applicable)
- Date of donation
- Optional public message or comment from the donor
- Content Creator channel/platform (if applicable)
Donors may request to remain anonymous or to have their information removed from the DONORS.md file at any time by contacting Licensor.
#### 12.2.5 Attribution Waiver and Perpetual License via Donation
Content Creators who provide a minimum donation through official donation channels receive:
- **Per-Mod Coverage**: Each donation covers one (1) specific Mod for which the donation was made
- **Auto-Waiver After 2 Mods**: Upon donating for any 2 Mods, all remaining Mods developed by Licensor are automatically covered without additional payment
- **Attribution Waiver**: Complete waiver of all attribution requirements under Section 13 for the Mod(s) and Mods covered by this tier
- **Perpetual License**: Unlimited, perpetual right to use covered Mods in monetized content creation, streaming, and derivative works without additional licensing fees, renewal requirements, or future payments
- **No Recurring Costs**: Each donation establishes a permanent license for that Mod; Content Creators are never required to donate again for covered Mods or pay additional fees for continued use
- **Coverage**: The donation(s) cover use of the Content Creator's channel or brand in all content, across all platforms, indefinitely
**Example Scenario:**
A Content Creator with 75,000 subscribers donates $20 for Mod A and $20 for Mod B. They have now satisfied the 2-Mod cap and automatically gain the attribution waiver and perpetual license for Mods C, D, E, and all other Licensor Mods without additional payment.
#### 12.2.5.1 SMP Donation Coverage
For Custom SMP projects that have paid the seasonal fee:
- All participating Content Creators and team members automatically receive the same attribution waiver and perpetual license benefits as standard donors
- The $20 seasonal fee covers unlimited Mod usage **for all Mods released under this License** for all team members for the season
- No individual Content Creator needs to make separate donations if the SMP has paid the seasonal licensing fee
#### 12.2.6 Alternative to Donation: Written Permission Request
Content Creators who do **not wish to donate** may instead contact Licensor directly to request written permission to waive attribution requirements. This alternative path is **completely voluntary** and available to all Content Creators regardless of audience size or monetization status.
- Content Creators may request permission by contacting Licensor (contact information in Section 15)
- Licensor will review the request and provide written authorization if approved
- Upon approval, Content Creators receive the same attribution waiver as donors
- No payment or donation is required for this pathway
- Licensor's decision to approve or deny requests is at its sole discretion
#### 12.2.7 Verification and Audience Size Updates
- Content Creators must accurately report their subscriber/follower count at the time of donation
- If a Content Creator's audience size increases significantly, they are encouraged (but not required) to increase their donation tier; increased donations are voluntary and not mandatory
- Licensor reserves the right to request reasonable proof of audience size (public channel statistics) if donation tier is disputed
#### 12.2.7 Non-Monetized Creators
Content Creators who produce non-monetized content (no ads, sponsorships, or revenue generation) are **not required** to donate and may use Mods freely under standard attribution requirements in Section 13.
### 12.3 Monetization and Commercial Use Prohibition
Notwithstanding the free distribution of Mods, users may **NOT**:
- Charge fees for access to, download of, or use of any Mod
- Include Mods in paid software bundles, premium services, or subscription offerings
- Sell modified versions of Mods or claim ownership of Mod content
- Use Mods as the primary product in a commercial venture
The free nature of the Mods is fundamental to this License and may not be circumvented.

## 13. Content Creator Terms and Attribution Requirements
### 13.1 Applicability to Content Creators
The attribution and disclosure requirements in this section apply specifically to Content Creators whose use of Mods falls outside the scope of Personal Use as defined in Section 3.2.
### 13.2 Definition of Content Creator and Monetized Content
For purposes of this License:
- **"Content Creator"**: Any individual or entity who creates, produces, or distributes video, stream, podcast, or other media content featuring one or more Mods.
- **"Monetized Content"**: Any content creation or streaming activity where the creator receives any form of compensation, revenue, sponsorship, or financial benefit, whether directly from viewers/platforms (ads, subscriptions) or indirectly (sponsorships, donations, brand deals).
Personal gameplay recordings, non-monetized educational videos, and private streaming are not considered monetized content for purposes of this section.
### 13.3 Attribution Requirements for Monetized Content
Content Creators who produce monetized content featuring Mods released by Licensor must provide clear attribution as follows:
#### 13.3.1 Standard Attribution Requirements
- **Mod Name**: The official name of the Mod must be clearly stated
- **Creator Attribution**: The Mod must be attributed to "Insanity Labs" or "Insanity Studios" as applicable
- **Download Link**: A clickable link or clear reference to where viewers can download or find the Mod must be provided
- **Placement**: Attribution must be provided in one or more of the following locations:
- Video description (for YouTube, Twitch VODs, or similar platforms)
- Pinned comment or community post
- On-screen text or overlay during gameplay footage
- Stream title or panels (for live streams)
#### 13.3.2 Attribution Waivers
Attribution requirements are **waived** in the following circumstances:
**Waiver 1 - Donation Channel**: Content Creators who have made a donation through official Licensor donation channels (Ko-fi, Patreon, or others designated by Licensor) automatically waive the attribution requirement for all Mods. Donors need not provide attribution or download links for any Mod used in their content.
**Waiver 2 - Library Mods**: Mods officially designated as "Library Mods" by Licensor do **NOT** require attribution or download links in any content, regardless of monetization status or whether the content is produced by a Content Creator. Library Mods are utility dependencies intended to be used by other Mods and may be referenced without attribution.
**Waiver 3 - Non-Marked Extension Mods in Modpacks**: If a Mod is used as an extension or dependency (through documented Extension API) within a public modpack, and the Mod is **NOT** marked as a Library Mod, the Content Creator may provide attribution to the modpack rather than the individual Mod, provided:
- The public modpack project page is clearly linked
- The modpack includes proper documentation listing all included Mods
- Viewers can discover the individual Mod through the modpack documentation
**Waiver 4 - Direct Permission**: Content Creators may request written permission from Licensor to use a Mod in monetized content without providing standard attribution. Licensor may grant such permission at its sole discretion. Contact information is provided in Section 15.
### 13.4 Mod Usage Disclosure
Regardless of attribution requirements, Content Creators are strongly encouraged to disclose which Mods they are using in their content so that viewers:
- Know which Mods enhance the gameplay experience
- Can attempt to recreate the setup shown in the content
- Have the opportunity to download and use the Mods themselves
This disclosure supports community engagement and Mod discoverability.
### 13.5 Content Creator Rights and Speech
### 13.5.1 Freedom of Expression
Content Creators retain complete freedom to express their opinions, criticism, and feedback regarding Mods released by Licensor. This includes:
- Negative reviews or criticism of Mod functionality, design, or features
- Statements that a Mod is "the worst Mod ever," poorly designed, or otherwise unfavorable
- Identification of bugs, performance issues, or incompatibilities
- Suggestions for improvement or redesign
- Comparison to other Mods or projects
- General opinion and commentary on the Mod's merits or shortcomings
Licensor does not restrict, censor, or penalize Content Creators for negative opinions, fair criticism, or constructive feedback.
### 13.5.2 Responsible Communication
While Content Creators have freedom of expression, Licensor encourages responsible and good-faith communication:
- Criticism should be based on genuine experience with the Mod
- Statements should be accurate and not deliberately misleading
- Feedback should be constructive and respectful when possible
- Content Creators may face community backlash or loss of credibility for dishonest or inflammatory content (but this is a consequence of community response, not Licensor enforcement)
### 13.5.3 No Retaliation or Censorship
Licensor commits to:
- Never taking legal action against a Content Creator solely for criticism or negative opinions
- Never filing copyright strikes, DMCA takedowns, or complaints to platforms based on criticism
- Never revoking a Content Creator's rights to use the Mods based on criticism
- Never engaging in harassment or coordinated attacks in response to criticism
Disagreement with criticism does not constitute grounds for action under this License.
### 13.6 No Claim to Content Creator Revenue
Licensor explicitly states:
- Content Creators retain all revenue, donations, sponsorships, and monetary compensation generated from their content
- Licensor makes no claim to Content Creator earnings or monetization
- Content Creator sponsorships with other brands do not require Licensor approval or notification
- Licensor will not contact platforms to request revenue sharing or compensation for Mod usage in content
Mods are provided free of charge with the understanding that Content Creators may generate revenue through their content creation activities. This is not a conflict with the free distribution of the Mods.
### 13.7 Content Creator Responsibility
Content Creators remain responsible for:
- Ensuring they have appropriate licensing and permissions for all other content, backgrounds, and assets used alongside Mods
- Complying with platform-specific rules and guidelines (YouTube, Twitch, etc.)
- Disclosing any sponsorships or paid partnerships as required by law and platform policy
- Providing accurate information about Mod functionality and features
