# Alkeari License Agreement (ALA)

### 1. Definitions
- 1.1 “Licensor” refers to Alkeari, the creator and owner of the Work(s).
- 1.2 “Licensee” refers to any individual or entity that obtains, uses, or distributes the Work(s).
- 1.3 “Work” or “Works” refers collectively to any electronic file, software, asset, data pack, resource pack, configuration, documentation, or related digital content created and distributed by the Licensor.
- 1.4 “Official Source” refers to distributions of the Work(s) provided directly by the Licensor via:
- The Licensor’s GitHub repository [Alkeari](https://github.com/Alkeari)
- The Licensor’s Modrinth page [Alkeari](https://modrinth.com/user/9IJRxzj8)
- The Licensor’s CurseForge page [Alkeari](https://www.curseforge.com/members/alkeari/)

Any other distribution channels must be explicitly approved in writing by the Licensor.

### 2. Grant of License
- 2.1 Subject to the terms and conditions of this Agreement, the Licensor grants the Licensee a non-exclusive, worldwide, royalty-free, revocable license to:
- a) Use the Work(s) for personal, private, or public purposes.
- b) Include the unmodified Work(s) within a digital collection, bundle, or distribution (e.g., modpacks, resource collections), whether free or commercial, provided the Licensee complies with Section 3 (Restrictions) and Section 4 (Distribution).

### 3. Restrictions
- 3.1 The Licensee shall not, without prior written approval from the Licensor:
- a) Modify, adapt, or create derivative works of the Work(s).
- i. Translating textual content (e.g., localization files) is permitted, provided no source code or binary assets are modified, and the translation remains clearly identified as unofficial or community-based.
- b) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Work(s).
- c) Host or provide direct download links to the Work(s) on any platform other than an Official Source. Bundling the unmodified Work(s) into a collection is permitted under Section 4, provided no direct download URL is included—only a link to an Official Source.
- d) Claim authorship of, present as their own, or republish the Work(s) under any name other than the original provided by the Licensor.
- e) Sell, rent, lease, sublicense, or otherwise transfer the Work(s) to any third party except as expressly permitted in Section 4.

### 4. Distribution of Collections
- 4.1 The Licensee may bundle and distribute the official Work(s) within a digital collection or project, whether free or commercial, under these conditions:
- a) The Work(s) must remain unmodified and retain all original files and metadata provided by the Licensor (including this license).
- b) The distribution must include a link to at least one Official Source.
- c) The Licensee must not host or provide direct download links to the Work(s) on any platform other than an Official Source without prior written approval from the Licensor.
- d) If the Licensor requests removal of the Work(s) from any distribution, the Licensee must remove the Work(s) from all distribution channels and servers and permanently delete any copies within seven (7) days of notification.

### 5. Commercial Use
- 5.1 The Licensee is permitted to include the Work(s) in commercial projects or servers, and may earn revenue from such distributions, provided all other terms of this Agreement are met.
- 5.2 The Licensor reserves the right to withdraw permission for any distribution by providing written notice via GitHub (e.g., opening an issue), Modrinth direct message, or Discord direct message. Official notices will be timestamped and preserved for reference. Upon such notice, the Licensee must cease distribution within seven (7) days and delete all copies.

### 6. Source Availability
- 6.1 The Licensor’s sole authorized distribution channels for source code and official binaries are the Official Sources.
- 6.2 Any other locations claiming to provide the Work(s) or source code are unauthorized and should be reported to the Licensor immediately. Any unauthorized copies discovered must be destroyed immediately upon discovery.
- 6.3 The Licensee is not permitted to re-host, mirror, or distribute the source code in any form without prior written approval from the Licensor.

### 7. Removal and Termination
- 7.1 The Licensor may revoke this license at any time and for any reason by providing written notice via GitHub, Modrinth, or Discord. Upon receipt of such notice, the Licensee must:
- a) Cease all use and distribution of the Work(s).
- b) Permanently delete all copies of the Work(s), including any backups, within seven (7) days.
- 7.2 This Agreement and the rights granted herein will terminate automatically if the Licensee fails to comply with any term or condition of this Agreement. Upon termination, the Licensee must immediately destroy all copies of the Work(s). This clause shall survive termination of the license.

### 8. Disclaimer of Warranty
- 8.1 THE WORK(S) ARE PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. THE LICENSOR HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- 8.2 THE LICENSOR DOES NOT WARRANT THAT THE WORK(S) WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THE LICENSEE ASSUMES ALL RISKS ASSOCIATED WITH USE OF THE WORK(S).
- 8.3 Third-party content (including other assets bundled in a collection) is not covered by this Agreement; the Licensee must refer to those authors’ licenses for any warranties or terms.

### 9. Limitation of Liability
- 9.1 TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE USE OR INABILITY TO USE THE WORK(S), INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- 9.2 THE LICENSOR’S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT OF ANY COST OR FEE PAID BY THE LICENSEE TO OBTAIN THE WORK(S), IF ANY, OR ONE DOLLAR (USD $1.00) IF NO COST WAS PAID.

### 10. Support and Bug Reporting
- 10.1 The Licensor provides no obligation to offer updates, patches, or support for the Work(s), but encourages Licensees to report bugs or request features by opening an issue on the Licensor’s GitHub repository. The Licensor may accept community patches via Pull Requests but reserves the right to accept or reject any contribution.
- 10.2 The Licensee may also contact the Licensor via the official Discord or Modrinth comment threads for assistance.
- 10.3 Use of community patches or contributions does not create a joint development or contributor license unless explicitly stated in writing by the Licensor.

### 11. Governing Law and Jurisdiction
- 11.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict of law principles.
- 11.2 Any dispute arising under or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Davidson County, Tennessee.

### 12. Entire Agreement
- 12.1 This Agreement constitutes the entire agreement between the Licensor and the Licensee concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
- 12.2 If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
- 12.3 No modification, amendment, or waiver of any provision of this Agreement will be effective unless in writing and signed by the Licensor.
