Commercial Attribution Requirement

This clause defines the conditions under which attribution is required for the use of this Software.

1. Definitions

"Software" refers to the original code and associated files provided by the Licensor. this includes textures models and all other related assets
"Licensor" refers to lucy_the_null on curseforge.
"Commercial Use" means any use, distribution, or modification of the Software (or any derived work) that is intended for, or directed toward, commercial advantage or monetary compensation. This includes, but is not limited to, embedding the Software in a product or service that is sold, licensed, offered for a fee or on a page or place if ad monetization is present.
“Derived Work” means any work, whether in whole or in part, that is based upon, adapted from, influenced by, or otherwise incorporates elements of the Software, regardless of whether such work constitutes a modification, translation, transformation, reinterpretation, or creative reimagining.

This includes, but is not limited to:
- Direct copies, adaptations, or modifications of the Software’s code, assets, structure, or functionality
- Works that replicate or emulate the distinctive features, design, mechanics, or expressive elements of the Software
- Works that are substantially inspired by the Software’s themes, aesthetics, or conceptual framework, even if no literal copying occurs
A work shall be considered “derived” if it would not have been created in substantially the same form or substance but for the existence of the Software.

2. Commercial Attribution Requirement

The requirement for attribution is waived for all non-commercial use of the Software.

However, if the Software is used for a Commercial Purpose, the Licensee MUST provide clear and conspicuous attribution to the Licensor in the final commercial product or service.

3. Form of Required Attribution

The attribution must be included in at least one prominent and clearly visible location, such as the product's "About" box, splash screen, permanent documentation, or any accessible text box, image, or page that is reasonably likely to be seen by end users during normal use.. The attribution must be presented in the following format:

4. Commercial Use Exemption

The Licensee is exempt from all other attribution requirements (such as including a full license copy or copyright notice) in the final end-user product documentation, provided the attribution in Section 3 is fulfilled.
