3. FREAKLAND MODPACK RESTRICTION

Except as provided in Section 4, the Software, including modified,
forked, ported, renamed, or otherwise derivative versions of the
Software, may not be included, bundled, distributed, or otherwise
made available as part of a Minecraft modpack whose title, display
name, project name, slug, or primary branding contains any of the
following terms, case-insensitively:

- "Freakland"
- "Freak Land"
- "Freak-Land"

This restriction includes, but is not limited to, names such as:

- Freakland
- Freakland Create
- Freakland Reborn
- Freakland Remake
- Freakland Ultimate
- Unofficial Freakland
- Freak Land Create
- Freak-Land Create

Changing capitalization, spacing, punctuation, or adding additional
words does not avoid this restriction if the modpack still uses one
of the restricted terms listed above.

4. LICENSOR'S OWN MODPACKS AND AUTHORIZED MODPACKS

The restriction in Section 3 does not apply to Minecraft modpacks
published, maintained, or officially authorized by the Licensor.

For the purposes of this License, the "Licensor" is:

Peacefull02 (AKA softboundless)

This includes, without limitation:

- the CurseForge account "Peacefull02";
- the GitHub account "softboundless";
- any other account, organization, project, or publishing identity
  that the Licensor publicly identifies as being owned or controlled
  by the Licensor.

The Licensor may use the Software in the Licensor's own modpacks
regardless of whether their names contain "Freakland", "Freak Land",
"Freak-Land", or any other restricted term listed in Section 3.

A third party may also use the Software in a modpack otherwise
restricted by Section 3 if that third party has received prior
written permission from the Licensor.

Such permission may be granted by the Licensor through a publicly
verifiable or direct written communication, including, for example,
a GitHub message, CurseForge message, email, or another written
communication attributable to the Licensor.

5. NO CIRCUMVENTION

A person may not circumvent the restriction in Section 3 by:

- redistributing a modified or renamed version of the Software;
- creating a fork or port of the Software;
- changing the Software's file name, project name, package name,
  mod identifier, or branding;
- removing or replacing this License;
- distributing the Software through an intermediary for inclusion
  in a Restricted Modpack.

The permissions granted by this License are conditional upon
compliance with its terms.

6. TERMINATION

If a person violates the terms of this License, the permissions
granted to that person under this License terminate automatically
for the duration of the violation.

Permissions may be restored if the violation is fully corrected and
the Software is no longer used or distributed in violation of this
License.

The Licensor may separately grant written permission or waive a
specific restriction for a particular person, project, or modpack.

7. TRADEMARKS AND PROJECT NAMES

This License grants rights to the Software only.

It does not grant any rights to use the Licensor's names, usernames,
logos, project branding, or other identifiers in a manner that
suggests sponsorship, endorsement, affiliation, or official status
where no such relationship exists.

8. DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NONINFRINGEMENT.

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY
CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT,
TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE
SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
