This license applies to any software project or digital product (the "Project") made available by NightLum under this license.

1. Definitions

"Project" means the software or digital product distributed under this license, including any NightLum-owned source code, compiled binaries, assets, data files, and documentation included with it.

"Modified Version" means a version of the Project that contains modifications, adaptations, or other changes to materials owned by NightLum.

"Independent Add-on" means a separately developed mod, plugin, extension, integration, compatibility layer, or other software that interoperates with the Project without incorporating, copying, or redistributing NightLum-owned source code, assets, or other protected materials from the Project.

"Distribution" means providing copies of the Project, a Modified Version, or NightLum-owned components of either to a third party, whether by publishing, uploading, sharing, transferring, sublicensing, selling, or otherwise making such copies available.

"Commercial Use" means use primarily intended for or directed toward commercial advantage or monetary compensation.

2. License Grant

Subject to the terms of this license, NightLum grants you a limited, non-exclusive, non-transferable license to:

- download, install, run, and use the Project;
- use the Project for commercial and non-commercial purposes;
- operate the Project as part of a private or publicly accessible server, hosted service, product, or workflow;
- modify the Project and create Modified Versions for your own internal use, including use on servers, services, products, or workflows operated by you.

No ownership rights are transferred under this license.

3. Distribution Restrictions

Unless you have received prior written permission from NightLum, you may not:

- distribute or redistribute the Project, in whole or in part;
- publish, upload, share, sublicense, sell, rent, lease, or otherwise make copies of the Project available to third parties;
- distribute or make available any Modified Version;
- distribute NightLum-owned source code, assets, binaries, or other protected components extracted from the Project;
- incorporate NightLum-owned source code or assets from the Project into another distributed project;
- present the Project, or NightLum-owned portions of a Modified Version, as your own work.

Running the Project or a Modified Version on a server or hosted service does not by itself constitute Distribution, provided that copies of the Project, Modified Version, or NightLum-owned components are not made available to users or other third parties.

4. Independent Add-ons and Interoperability

You may create, use, publish, distribute, and commercially exploit Independent Add-ons that interoperate with the Project.

Independent Add-ons may use or reference publicly exposed or documented identifiers, APIs, configuration interfaces, extension points, protocols, or other interfaces of the Project for interoperability.

An Independent Add-on must not contain, reproduce, redistribute, or incorporate NightLum-owned source code, assets, binaries, or other protected materials from the Project except where expressly permitted by NightLum or applicable law.

An Independent Add-on remains the property of its respective author or rights holder. Creating an Independent Add-on in accordance with this section does not grant NightLum ownership of that Independent Add-on.

Nothing in this license restricts rights that cannot lawfully be restricted by contract, including any applicable statutory rights relating to interoperability.

5. Contributions

Bug reports, suggestions, patches, code contributions, and other materials submitted to NightLum are not automatically transferred to NightLum merely by being submitted.

NightLum may establish separate contribution terms for accepting code or other copyrightable contributions into the Project.

Unless such terms have been accepted by the contributor, submission of a contribution does not by itself grant NightLum ownership of the contributor's intellectual property.

6. Ownership and Third-Party Rights

NightLum retains all rights, title, and interest that NightLum owns in the original Project and in NightLum-owned materials contained in any Modified Version.

This license does not transfer to NightLum ownership of independently created code, assets, or other materials owned by third parties.

Third-party software, assets, trademarks, and other intellectual property included in or used with the Project remain subject to their respective licenses, terms, and ownership.

Nothing in this license grants any right to use NightLum trademarks, logos, or branding except as necessary to accurately identify the Project or its origin.

7. Statutory Rights

Nothing in this license is intended to exclude, restrict, or override any right, exception, or limitation that cannot lawfully be excluded or restricted under applicable law.

To the extent that applicable law grants mandatory rights to an authorized user of software, including rights necessary for intended use, error correction, observation, study, testing, or interoperability, those statutory rights remain unaffected.

8. Warranty Disclaimer

To the extent permitted by applicable law, the Project is provided "as is" and without warranties or guarantees beyond those that cannot lawfully be excluded.

NightLum does not warrant that the Project will be error-free, uninterrupted, compatible with every system or third-party product, or suitable for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NightLum's liability arising out of or in connection with the Project is excluded or limited.

Nothing in this license excludes or limits liability to the extent that such exclusion or limitation is prohibited by applicable law, including liability that cannot legally be excluded for intentional misconduct or other mandatory grounds of liability.

10. Termination

The rights granted to you under this license terminate if you materially violate its terms.

Where the violation is capable of remedy, the rights granted under this license will be reinstated if you fully remedy the violation within 30 days after receiving notice of it from NightLum, unless NightLum has terminated the license for repeated or intentional violations.

Termination does not affect provisions which by their nature are intended to survive termination, including provisions concerning ownership, restrictions on unauthorized distribution, disclaimers, and liability.

11. Additional Permissions

NightLum may grant additional permissions or offer the Project under separate licensing terms.

Any permission to distribute the Project or a Modified Version must be granted by NightLum in writing.

12. Governing Law

This license is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules, to the extent that such choice of law is legally permitted.

Mandatory consumer protection provisions applicable to an individual licensee remain unaffected.

13. Severability

If any provision of this license is held to be invalid, unlawful, or unenforceable, the remaining provisions remain unaffected to the extent permitted by applicable law.

The invalid or unenforceable provision shall be treated in accordance with applicable law.
